1. Agreement to Terms

By accessing or using AI-My-Site (“Service“) — including our website, WordPress plugin, REST API, and dashboard — you agree to be bound by these Terms of Service (“Terms“). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

AI-My-Site provides infrastructure that allows website operators to expose their WordPress sites to AI language model agents in a structured, controlled, and auditable manner. The Service includes a WordPress plugin, a cloud dashboard, a REST API, and supporting tooling such as automatic llms.txt generation.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

We reserve the right to suspend or terminate accounts that breach these restrictions, with or without notice.

6. Subscriptions and Payment

The Service is offered on a free tier and paid subscription plans. Paid plans are billed monthly or annually in advance. All fees are stated in US Dollars (USD) and are exclusive of any applicable taxes.

You authorise us (via our payment processor, Stripe) to charge your payment method on each billing cycle. If a payment fails, we will attempt to notify you and may suspend your account until payment is received.

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by law.

7. Free Trial

We may offer a free trial for paid plans. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends. We will notify you before your trial expires.

8. Intellectual Property

All intellectual property rights in the Service (including the software, dashboard, plugin, documentation, and branding) are owned by or licensed to AI-My-Site Ltd. Nothing in these Terms transfers any ownership of these rights to you.

You retain all rights to your website content. By using the Service, you grant us a limited, non-exclusive licence to access and process your content solely to provide the Service to you.

9. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you agree to our data practices as described therein.

API request logs generated through your use of the Service are your data. We process them on your behalf as a data processor. You are responsible for ensuring your use of the Service complies with any data protection laws applicable to the content you expose through the API.

10. Uptime and Service Levels

We target 99.9% API uptime on Pro and Enterprise plans, measured monthly. Scheduled maintenance will be communicated in advance where possible. The Starter and Growth plans are provided without an uptime guarantee. We are not liable for downtime caused by events outside our reasonable control.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI-MY-SITE LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) £100 GBP.

13. Indemnification

You agree to indemnify and hold harmless AI-My-Site Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

14. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access to the Service immediately if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination before deletion, unless you request earlier erasure.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in the EEA, in which case you may also bring proceedings in your local courts.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI-My-Site regarding the Service. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right does not constitute a waiver of that right. You may not assign your rights under these Terms without our prior written consent.
